What is Bourbon? The Legal Definition
Bourbon is one of the most tightly regulated spirits in the world. To be called bourbon, a whiskey must meet strict legal requirements:
- Made in the United States
- Grain mash of at least 51% corn
- Distilled to no more than 160 proof (80% ABV)
- Aged in new, charred oak containers
- Entered into the barrel at no more than 125 proof (62.5% ABV)
- Bottled at a minimum of 80 proof (40% ABV)
There is no minimum age requirement for bourbon (except for "Straight Bourbon," which requires a minimum of two years). The new charred oak requirement is what gives bourbon its signature vanilla, caramel, and oak character.
Key Bourbon Styles
- Wheated Bourbon — Uses wheat as the secondary grain instead of rye, producing a softer, sweeter profile. Pappy Van Winkle, W.L. Weller, and Old Fitzgerald are the most famous examples — and among the most allocated bottles in the world.
- High-Rye Bourbon — Uses a higher proportion of rye grain, producing a spicier, more complex profile. Four Roses, Bulleit, and Basil Hayden's are popular examples.
- Bottled in Bond — A legal designation requiring the bourbon to be aged at least four years, bottled at exactly 100 proof, and produced at a single distillery in a single distilling season. BiB bourbons like Old Fitzgerald and Henry McKenna are among the most collectible in the category.
- Cask Strength / Barrel Proof — Bottled without dilution, at the full strength of the barrel. These expressions offer the most intense flavor and are highly prized by collectors. Booker's, Stagg, and William Larue Weller are benchmark examples.
The Allocated Bourbon Landscape
"Allocated" bourbon refers to bottles that are produced in limited quantities and distributed through a lottery or allocation system, meaning retailers receive only a small number of bottles per year. The most sought-after allocated bourbons include:
- Pappy Van Winkle — The holy grail. The 20 and 23-year expressions regularly sell for thousands of dollars on the secondary market.
- Buffalo Trace Antique Collection (BTAC) — Released annually each fall: George T. Stagg, William Larue Weller, Thomas H. Handy, Sazerac 18, and Eagle Rare 17. Each bottle is a collector's prize.
